United States Supreme Court Denies Review of Fogarty Case

On April 15, 2011, the United States Supreme Court denied the petition of the Orange County Social Services Agency asking for review of the decision of the lower court affirming an unprecedented award of $4.9 million to Fogarty-Hardwick and about $5 million to her attorneys for the wrongful removal and detention of her children in 2001.

After more than ten years of litigation, the case has apparently come to an end and the County of Orange is required to pay approximately $10 million in damages. Despite a jury finding that the social workers lied and fabricated evidence, and despite the court of appeals affirming the decision at least twice over the course of the lengthy litigation, the Orange County Social Services Agency continues to deny any wrong-doings and one of the social workers retired on a pension while the other was actually promoted to Supervisor and is making more than $103,400 a year!!! She now trains other social workers. The director of the department continues to defend these social workers and the agency despite multiple lawsuits and settlements against them in the last few years.
